Some Millennials also include unique clauses—like who keeps the dog or how to approach future disputes through mediation instead of litigation. These aren’t legally enforceable in every situation, but they reflect how personalized and thoughtful modern prenups have become.

The Role of Timing and Communication

One significant difference in how Millennials approach prenups is timing. Rather than waiting until the last minute, many couples begin the conversation early in their engagement—or even before it. This gives both parties the time and space to think through the agreement without pressure.

It’s also common for both partners to have their attorneys, which supports fairness and helps avoid future claims of coercion. The process becomes less about “protecting assets from each other” and more about planning how to build a life together with clarity and mutual respect.
