How Child Support Is Calculated in Suffolk County

In Suffolk County, child support is based on a formula that ensures both parents contribute fairly to their child’s needs, regardless of the family situation. The formula works like this: both parents’ incomes are combined, and a percentage of that combined income is allocated to child support.

The percentage is based on the number of children you have:

  • 17% for one child
  • 25% for two children
  • 29% for three children
  • 31% for four children
  • At least 35% for five or more children

For example, if you and the other parent earn $100,000 yearly and have one child, the court will start with 17 percent of that income, or $17,000, as the base child support amount. That figure is then divided between you and the other parent based on each parent’s income. If you earn 30 percent of the combined income, you’re presumed to be spending that portion on your child’s needs, while the other parent would be responsible for the remaining 70 percent.

Additional Expenses

Child support is not just about covering the basics. In addition to the base support amount, parents are also responsible for other necessary expenses such as:

  • Health insurance
  • Uncovered medical expenses
  • Childcare costs if the custodial parent is working or in school
  • Education costs

These additional expenses are shared between parents based on their income percentages, ensuring that both contribute to their child’s overall well-being.

What If Circumstances Change?

Life is unpredictable. Whether you lose a job, your financial situation changes or your child’s needs evolve, child support orders can be modified. If you’re struggling to keep up with payments due to a significant change in circumstances, we can help you petition the court for a modification.

At Aiello & DiFalco, we assist parents on both sides of child support cases. Whether you’re seeking a decrease in payments due to financial hardship or need an increase because of rising childcare costs, our attorneys will work with you to present a solid case to the court.
